Once again the editorial pages of newspapers throughout the country commented on the highly partisan Supreme Court with it’s one determining swing vote which establishes the Rule of Law for 335 million Americans.  Our liberties and democracy for the next forty-plus years have fallen victim to a corrupt senate leadership under “grim reaper” leader McConnell who effectively controls Judicial appointments. 

The actions of the Court this past week with regard to gerrymandering and the citizenship census question are only the beginning of that which is yet to come. Looming in the future of this partisan court is Roe v. Wade, health care, civil rights, voting rights, LBGTQ, citizenship and a host of issues dealing with political power, war powers, who is subject to the law, violation of an oath or lying under oath, pardons, etc.

The 2020 election is an opportune time to replace the old political deadwood of Congress and bring the Supreme Court into the 21st century by revising the congressionally approved Judiciary Act of 1869 which is the authority of the Federal Judiciary System under Article III of the Constitution.  

The 1869 Act, a hundred fifty years old was passed by Congress when there were 38 states, a population of 30 million, and a life expectancy of fewer than 60 years.  It is time to replace the 1869 Act with a 2021 Judiciary Act, expanding the judicial base so that it is more representative of our nation with appointments of qualified judges who are Native Americans, Muslin, Indian, Asian, Middle Eastern, LBGTQ, etc. and limiting their term of office.  Hopefully, in that manner, the Court can deal more effectively with a future that involves genetics, artificial intelligence, robotics, space law, alternate reality, computer identity, and only GOD knows what else.  To that end, I suggest the following be considered in replacing the Judiciary Act of 1869:

  • The Supreme Court should be comprised of Justices in a number equal to the number of Federal Appellate Court Districts (13 currently).  One of whom shall be designated, Chief Justice.
  • Supreme Court decisions require a two-thirds majority vote of the Court (9 Justices).
  • There are no lifetime appointments.  All Federal appointed Judges shall serve a single generational term of 25 years.
